Description of Program and Relief

Temporary Outdoor Dining Programs

The City of Cincinnati is making permits available for restaurants and bars to temporarily expand their outdoor dining and service areas onto public sidewalks or streets or into privately owned parking facilities in order to comply with COVID-19 prevention best practices.

Two separate permits are available, one for outdoor street dining and one for private outdoor dining. Applications for each are available at the link below.

Eligibility Requirements/Restrictions

The city has provided detailed guidelines and eligibility standards for each of the permits, which can be accessed at the link below. In addition to other requirements contained in these guidelines, the programs have the following eligibility requirements:

Outdoor Street Dining Program: Applicants must (i) hold a valid certificate of occupancy for restaurant operations adjacent to the area proposed for outdoor street dining, (ii) complete the online application and attach a site plan to the application with the proposed layout of the outdoor street seating dining area in accordance with the requirements set forth in the guidelines, (iii) agree to the terms and conditions in Section 6 of the guidelines, which, among other things, contains insurance requirements and (iv), if applicants plan to serve alcohol in their outdoor space, obtain required state liquor license approvals.

Private Outdoor Dining Program: Applicants must (i) complete the online application, which includes proof of an existing and valid certificate of operation for a restaurant or bar adjacent to the proposed outdoor seating area, a site plan, a plan of operation and written consent of the property owner for operation of the outdoor seating area (if application), (ii) acknowledge that the program is temporary, does not create a permanent right to operate and maintain the outdoor dining area and that approval is subject to additional conditions, modification or revocation at the City’ sole discretion and (iii) certify that any necessary liquor license approvals will be obtained, state accessibility regulations and city noise requirements will be complied with and no outdoor entertainment will be provided or permitted in the new dining area.
