Description of Program and Relief

City of Philadelphia: Paid Sick Leave Requirements

Philadelphia requires that businesses offer paid or unpaid sick leave to employees who work at least 40 hours per year within the city. Businesses with 10 or more employees must provide their employees with one hour of paid sick time for every 40 hours worked, up to a maximum of 40 sick time hours per calendar year. Businesses with fewer employees must provide employees with one hour of unpaid sick time for every 40 hours worked, subject to the same cap. The law has been in place since 2015, but was recently expanded so that employees who are covered “can use their paid sick leave for COVID-19 related business closures, quarantine, and to stay home with their children during school closures without fear of retaliation.”

Eligibility Requirements/Restrictions

To be eligible for paid sick time off, employees must perform at least 40 hours of work in Philadelphia per year. The law does not cover certain categories of employees, and expressly excludes:

  • Employees hired to work 6 months or less

  • Seasonal employees

  • Independent contractors

  • Employees covered by a collective bargaining agreement

  • Adjunct professors

  • Per diem / pool employees

  • Student interns

  • As noted above, annual sick-leave entitlements—whether paid or unpaid—are capped at 40 hours per calendar year

Application Deadlines (If Applicable)

An employee who experiences a violation of Philadelphia’s sick leave law may file a complaint against his or her employer. Complaints must be filed within one year of the underlying violation.
