Description of Program and Relief

Price Gouging Hotline/Complaint Form

The South Carolina Attorney General’s Office has declared South Carolina’s price gouging law to be in effect and has provided a hotline and email for any consumer to report complaints about “price gouging” of commodities or services in connection with the COVID-19 pandemic.

The South Carolina Attorney General’s Office asks consumers to document five things when they believe they have witnessed price gouging: 1) the place, address, and name of the business; 2) the price paid; 3) any prices on the same items or services from businesses nearby (and collect the same information on those businesses); 4) pictures that identify the business, along with the price; 5) the consumer’s name and contact information.

Effective immediately until such time as the state of emergency expires or the program is otherwise terminated.

Eligibility Requirements/Restrictions

South Carolina’s price gouging law (SC §39-5-145) states that that it is unlawful to “rent or sell or offer to rent or sell a commodity at an unconscionable price.”

Commodities are defined as: goods, services, materials, merchandise, supplies, equipment, resources, or other articles of commerce, and include, without limitation, food, water, ice, chemicals, petroleum products, and lumber essential for consumption or use as a direct result of a declared state of emergency.
