Litigation partner Lynn Bayard and litigation associate Timothy Martin published the article, "A Well-Tailored Remedy," in the December 2007 issue of IP Law & Business. The article discusses a bill introduced by Senator Schumer to protect fashion designs under the Copyright Act. Fashion designers, unlike other creators of original works in the US and unlike fashion designers abroad, are currently denied copyright protection in the United States, leaving them vulnerable to design theft and financial loss. The bill proposes to grant protection to original fashion designs for a limited term of three years, enabling designers to recoup their investments of time and money.
