April 25, 2007 Full PDF

Litigation partners Marty Flumenbaum and Brad Karp's "Second Circuit Review" column appeared in the April 25 New York Law Journal. The article, "Famous Marks Doctrine Rejected," discusses the U.S. Court of Appeals for the Second Circuit's recent decision in ITC Limited v. Punchgini, Inc. that created a circuit split with the U.S. Court of Appeals for the Ninth Circuit regarding the applicability of the "famous marks" exception to the territorial scope of trademark protection under federal law. Associate Joanna L.W. Trachtenberg assisted in the preparation of this column.
