An article by litigation partners Chris Boehning and Dan Toal appeared in the April 24 New York Law Journal. The article, "Ruling Leaves Ownership Issue Unresolved," discusses a recent decision by New York's Court of Appeals that has expanded the common law cause of action for conversion into the realm of the intangible, which the authors explain has been long reserved for tangible property. According to the Chris and Dan, the court ruled that in this case, Thyroff v. Nationwide Mutual Insurance Company, "a claim for conversion can be maintained in connection with the appropriation of electronically stored data."
