The New York Appellate Division, First Department, unanimously affirmed a grant of summary judgment entered by Justice Ramos of the Supreme Court, County of New York, Commercial Division, in favor of affiliates of our client Harbinger Capital Partners LLC.
The plaintiff was formerly a senior employee at Harbinger, which manages several hedge funds. The plaintiff sued Harbinger for approximately $35 million in deferred compensation allegedly owed to him following his termination in 2008. The Appellate Division agreed with Justice Ramos that under the governing contracts, properly interpreted, Harbinger did not owe the amounts in dispute.
