Second Circuit Review: Assessing District Court Decision to Let Jury Take Indictment Home

Litigation partners Martin Flumenbaum and Brad S. Karp's Second Circuit Review column appeared in the July 25 issue of the New York Law Journal. The article, "Assessing District Court Decision To Let Jury Take Indictment Home," discusses United States v. Esso, in which the Second Circuit found that allowing the jury to take a copy of the indictment home overnight to review did not violate George Esso's right to a fair trial. The court instructed jurors to neither share the indictment with anyone nor perform any additional research. While the district court's original decision was upheld, the Second Circuit cautioned district courts against implementing a practice of allowing jurors to take indictments home.
