Second Circuit Review: Supervised Release Not Terminated by Deportation

Litigation partners Martin Flumenbaum and Brad S. Karp's Second Circuit Review column appeared in the April 25 issue of the New York Law Journal.The authors discuss United States v. Roccisano,in which the U.S. Court of Appeals for the Second Circuit affirmed a district court's judgment of conviction sentencing a defendant to a 46-month term of imprisonment after the defendant pleaded guilty to one charge of illegally reentering the United States. The Second Circuit held that deportation does not terminate a defendant-alien's term of supervised release for purposes of applying the sentencing guidelines.
