Litigation partners Chris Boehning and Dan Toal's article "'Orbit One' Ruling Furthers Discussion on Sanctions" was published in the Technology Today section of the December 7 issue of the New York Law Journal. The article discusses the recent decision in Orbit One Communications v. Numerex Corp., which analyzes whether sanctions may be imposed for culpable discovery misconduct that does not result in the loss of potentially relevant evidence and departs from the framework laid out in Judge Scheindlin's landmark decision in Pension Committee.
