Second Circuit Review: Court Reaffirms Stringent Showing Required to Overturn Arbitral Award

Litigation partners Marty Flumenbaum and Brad Karp's Second Circuit Review column appeared in the February 27 issue of the New York Law Journal. In this article the authors discuss Scandinavian Reinsurance Co. Ltd. v. St. Paul Fire & Marine Insurance Co., in which the U.S. Court of Appeals for the Second Circuit overruled a lower court decision vacating an arbitral award. The court concluded that the circumstances at issue ‑ two members of the arbitral panel failed to disclose that they served together on a panel in another, similar case ‑ were insufficient to support a finding of "evident partiality." Litigation associate Austin Thompson assisted in the preparation of the article.
