Litigation partners Martin Flumenbaum and Brad Karp’s latest Second Circuit Review column, “Permissibility of Offsetting Criminal Forfeiture Orders by Preemptive Restitution Payments,” was published in the June 30 issue of the New York Law Journal. The authors discuss the circuit’s recent decision in United States v. Bodouva, which addressed whether restitution offsets could be used to lower, or even eliminate, criminal forfeiture orders.
